1. Acceptance of Terms

By downloading, installing, or using the MindSort application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

We reserve the right to modify these Terms at any time. Your continued use of the App after any changes indicates your acceptance of the modified Terms.

2. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install the App on a device that you own or control
  • Use the App for your personal, non-commercial purposes

3. Restrictions

You agree not to:

  • Copy, modify, or distribute the App or any part of it
  • Reverse engineer, decompile, or disassemble the App
  • Remove or alter any proprietary notices or labels on the App
  • Use the App for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to the App's code or systems
  • Use the App in any way that could damage, disable, or impair our services
  • Resell, sublicense, or commercially exploit the App without our permission

4. Your Content

The App allows you to create, store, and manage content including thoughts, notes, reminders, and other data ("Your Content"). You retain all rights to Your Content.

Since all content is stored locally on your device and is not transmitted to our servers, you are solely responsible for:

  • Backing up Your Content
  • The legality and appropriateness of Your Content
  • Maintaining the security of your device

5. Intellectual Property

The App, including its design, features, code, graphics, and all related intellectual property, is owned by MindSort and protected by copyright, trademark, and other intellectual property laws.

"MindSort" and the MindSort logo are trademarks of MindSort. You may not use these trademarks without our prior written permission.

6. Third-Party Components

The App may include third-party open-source components, including AI models for speech recognition and text classification. These components are subject to their own license terms, which you agree to abide by when using the App.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or reliability of AI-generated transcriptions or classifications
  • Uninterrupted or error-free operation

We do not guarantee that the App will meet your requirements or that the AI features will be accurate in all circumstances. You acknowledge that AI-generated content may contain errors.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MINDSORT SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of data, profits, or business opportunities
  • Any damages arising from your use or inability to use the App
  • Any errors or inaccuracies in AI-generated content
  • Any unauthorized access to your device or data

Our total liability to you for any claims arising from or related to these Terms or the App shall not exceed the amount you paid for the App, if any.

9. Indemnification

You agree to indemnify, defend, and hold harmless MindSort and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the App or violation of these Terms.

10. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for any reason, including if you breach these Terms.

Upon termination, your license to use the App will immediately cease. You may terminate these Terms at any time by uninstalling the App from your device.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in the United States.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MindSort regarding the use of the App and supersede any prior agreements.
